Joyn Healthcare — Member Terms of Service

1. Agreement to Terms
Welcome to Joyn Healthcare ("Joyn," "we," "us," or "our"). These Terms of Service ("Terms") are a legal agreement between you ("Member," "you," or "your") and Sizzle Creative Agency LLC, a Missouri limited liability company doing business as Joyn Healthcare ("Company").
By creating an account, purchasing a membership, or using any part of the Joyn Healthcare platform, including our website at joynhealthcare.com, mobile applications, and related services (collectively, the "Platform"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.
If you are using the Platform on behalf of a household or family, you represent that you have the authority to bind all household members to these Terms.
2. What Joyn Is (and What Joyn Is Not)
2.1 Joyn Is a Marketplace
Joyn Healthcare is an online marketplace platform that connects members with independent, licensed healthcare providers ("Providers") who offer services at transparent, upfront cash prices. Joyn facilitates the discovery of Providers, the scheduling of appointments, and the processing of payments between Members and Providers.
2.2 Joyn Is Not Insurance
IMPORTANT: JOYN HEALTHCARE IS NOT AN INSURANCE COMPANY. JOYN DOES NOT PROVIDE HEALTH INSURANCE, HEALTH COVERAGE, OR A HEALTH PLAN OF ANY KIND. Your Joyn membership does not constitute insurance coverage, a health benefit plan, or a substitute for health insurance. Joyn does not guarantee, pay for, or reimburse healthcare services. Joyn does not make coverage determinations, adjudicate claims, or assume any financial risk for your healthcare expenses.
2.3 Joyn Does Not Provide Medical Services
Joyn does not provide medical advice, diagnoses, treatments, or any healthcare services. All healthcare services available through the Platform are provided by independent, licensed Providers who are not employees, agents, or representatives of Joyn. Joyn does not endorse, recommend, or guarantee any specific Provider, treatment, or outcome.
2.4 Relationship Between Member and Provider
The relationship between you and any Provider you engage through the Platform is a direct relationship between you and that Provider. Joyn is not a party to that relationship. You are solely responsible for evaluating the qualifications, credentials, and suitability of any Provider before receiving care.
3. Membership
3.1 Eligibility
To create an account and become a Member, you must be at least 18 years old and a resident of the United States. Members may add household dependents of any age to their account.
3.2 Account Registration
You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3 Membership Plans
Joyn offers the following membership plans:
- Monthly membership: $9.99 per month, billed monthly.
- Annual membership: $99 per year, billed annually.
Membership fees grant access to the full Platform features, including provider search, booking, payment processing, Health Wallet, care history, and savings tracking. Membership fees are separate from and in addition to any fees you pay directly to Providers for healthcare services.
3.4 Billing and Renewal
Membership fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your payment method on file will be automatically charged at the beginning of each billing cycle. You authorize Joyn to charge your payment method for all applicable fees.
3.5 Cancellation
You may cancel your membership at any time through your account settings or by contacting support at support@joynhealthcare.com. Cancellation takes effect at the end of your current billing period. No partial refunds are provided for unused portions of a billing period. Upon cancellation, you will retain access to Platform features through the end of your paid period, after which your account will revert to limited access.
3.6 Free Browsing
Certain portions of the Platform, including the provider directory and price information, may be available to non-members at our discretion. Booking, payment, Health Wallet, and other features require an active membership.
4. Health Wallet
The Joyn Health Wallet ("Wallet") is a stored-value balance within the Platform that Members may use to pay for healthcare services booked through the Platform. The Wallet is a payment convenience feature, not a bank account, investment product, savings account, or health benefit. Full Wallet terms are available at joynhealthcare.com/wallet-terms.
5. Booking and Payments
5.1 Booking Services
When you book a service through the Platform, you are entering into a direct transaction with the Provider, not with Joyn. Joyn facilitates the booking and payment but is not a party to the service agreement between you and the Provider.
5.2 Pricing
All prices displayed on the Platform are set by the Providers and represent the cash price for the specified service. Insurance comparison prices displayed on the Platform are estimates based on publicly available data and are provided for informational purposes only. Actual insurance costs vary by plan and provider.
5.3 Payment Processing
Joyn uses Stripe, Inc. as its payment processor. By using the Platform, you agree to Stripe's terms of service. When you book a service, a pre-authorization hold is placed on your selected payment method (Wallet or card) for the quoted amount. Upon completion of the service, the hold is converted to an actual charge.
5.4 Cancellation and Refunds
- Cancellations 24+ hours before appointment: Full refund to your original payment method or Wallet credit (your choice).
- Cancellations within 24 hours of appointment: A cancellation fee may apply (amount set by the Provider, typically $25). The remainder is refunded.
- Provider-initiated cancellations: Full refund, no fees.
- No-shows: If you fail to attend a booked appointment without canceling, the full amount may be charged.
5.5 Disputes
If you have a dispute regarding a service or charge, contact us at support@joynhealthcare.com within 30 days of the transaction.
6. Ratings and Reviews
Only Members who have completed a verified booking through the Platform may submit a review for that specific visit. Reviews must be honest, accurate, and based on your personal experience. Reviews are public and visible to all Platform users. Your review will display your first name and last initial. Reviews cannot be edited after 48 hours and cannot be deleted by you after publication.
7. Member Conduct
You agree not to:
- Provide false or misleading information during registration or booking.
- Use the Platform for any unlawful purpose.
- Attempt to book appointments you do not intend to attend.
- Engage in patterns of repeated cancellations designed to harm Providers.
- Attempt to circumvent Platform payment processing by paying Providers directly for services booked through Joyn.
- Interfere with or disrupt the Platform, servers, or networks.
- Scrape, harvest, or collect data from the Platform without our written consent.
- Impersonate any person or entity.
8. Intellectual Property
All content, features, and functionality of the Platform, including text, graphics, logos, icons, images, audio, video, software, and the Joyn name and brand, are owned by Joyn and are protected by copyright, trademark, and other intellectual property laws.
9. Privacy
Your use of the Platform is subject to our Privacy Policy. By using the Platform, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
10. Disclaimers
THE PLATFORM DOES NOT PROVIDE MEDICAL ADVICE. CONTENT ON THE PLATFORM IS FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. INSURANCE PRICE COMPARISONS DISPLAYED ON THE PLATFORM ARE ESTIMATES AND ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOYN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL JOYN'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF: (A) THE TOTAL MEMBERSHIP FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
12. Indemnification
You agree to indemnify, defend, and hold harmless Joyn and its officers, directors, employees, agents, and affiliates from and against any and all claims arising out of or related to your use of the Platform, your violation of these Terms, your interaction with any Provider, or any content you submit to the Platform.
13. Dispute Resolution and Arbitration
Before initiating any formal dispute resolution, you agree to first contact us at support@joynhealthcare.com and attempt to resolve the dispute informally for at least 30 days. If we cannot resolve a dispute informally, you and Joyn agree that any dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA"), conducted in St. Louis, Missouri.
YOU AND JOYN AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
14. Modifications to Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Platform at least 30 days before the changes take effect.
15. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our reasonable discretion. Upon termination, any Wallet balance will be returned to you via your original funding method within 30 days.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles.
